1. Overview and Acceptance

Welcome to Engineered Spanish. By accessing our website, purchasing lesson packages, or booking sessions, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use our services.

2. Eligibility (Age Requirement)

Our services are exclusively available to individuals who are at least 18 years of age. By booking a lesson or purchasing a package, you confirm that you meet this age requirement. Engineered Spanish does not knowingly collect information from or provide services to minors.

3. Services Provided

Engineered Spanish provides online, one-on-one (1:1) personalized Spanish language lessons. Each standard session lasts 50 minutes and is conducted virtually via Google Meet. Scheduling is managed via Calendly, and payments are securely processed through PayPal.

4. Scheduling, Attendance & Expiration

• Punctuality & Grace Period: A 15-minute wait time is observed in Google Meet. If you arrive late, the session will still end exactly 50 minutes after the scheduled start time. If you do not join within the 15-minute grace period, the session is treated as a no-show and forfeited.

• Package Validity: Lesson packages must be completed within their designated timeframe from the purchase date:

  • 4-Class Package: Expires in 5 weeks.

  • 8-Class Package: Expires in 10 weeks.

  • 12-Class Package: Expires in 15 weeks.

    Expired classes are non-refundable and non-transferable.

• Cancellations & Refunds: All cancellation, rescheduling, and refund rules are strictly governed by our standalone Refund & Cancellation Policy. Rescheduling requires at least 24 hours’ advance notice.

5. Technical Requirements & Student Responsibility

• You are responsible for maintaining a reliable, high-speed internet connection, along with a functional webcam and microphone.

• Technical disruptions on the student’s side (e.g., power outages, poor Wi-Fi, equipment failure) do not qualify for make-up time or refunds. Disruptions caused by the instructor will be rescheduled at no extra charge.

6. Intellectual Property & Prohibited Recording

• All custom lesson notes, learning frameworks, study guides, and digital materials provided by Engineered Spanish are protected intellectual property and are solely for your personal, non-commercial use. You may not distribute, duplicate, publish, or resell these materials.

• No Recording: Recording lessons (audio or video) via software or screen-capture tools is strictly prohibited without prior written mutual consent.

7. Code of Conduct & Termination

We maintain a professional, respectful learning environment. Engineered Spanish reserves the right to immediately terminate a session and cancel services without refund in the event of harassment, abusive language, inappropriate behavior, or safety violations.

8. Learning Disclaimer

Language acquisition depends entirely on individual practice, consistency, cognitive ability, and time commitment. Engineered Spanish offers structured pedagogy and educational guidance, but does not guarantee specific fluency levels, test results, or professional career outcomes.

9. Limitation of Liability

To the fullest extent permitted by law, Engineered Spanish shall not be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use our services, or from downtime/failures of third-party platforms (Google Meet, Calendly, PayPal).

10. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Ecuador. Any disputes arising in connection with these terms shall be subject to the jurisdiction of the competent courts of Guayaquil, Ecuador.
